The Arizona Attorney General’s Office says state officials will not be held liable for distributing $260 million to public schools as approved by voters last month.
State Treasurer Jeff DeWit requested the opinion in light of pending lawsuits claiming the voter-approved school funding formula in Proposition 123 violates state law.
The state Board of Investment will vote on sending the money to schools at its June 28 meeting.
DeWit, a vocal opponent of Proposition 123 called the Board of Investment meeting but declined to say how he will vote on the distribution.
The attorney general’s opinion said state officials are required to follow the law until a court intervenes.
